Modify Existing Orders
After support is ordered, the amount of support payable and the duration of payment may only be modified upon a showing of a change in circumstances or other qualifying event. You must file a motion to change the orders.
For instance, a change that reduces or increases the financial need for the amount ordered such as loss of employment or an increase in the income of the supported party.
In some instances, the supported party may be ordered to become employed after a reasonable period of time. If the supported party fails to get employment or make an effort to do so, the support order may be modified to reduce support.
In marriages of long duration, typically 10 years or more, the law provides that unless otherwise agreed upon, an order for support terminates upon the death of either party or remarriage of the party receiving support.
However, if the parties specifically agree that an order for support is not subject to modification or termination, the amount payable may never be modified regardless of changed circumstances.
